It is recommended and strongly advised to review and follow the data sheets, inserts, instructions for use which accompany the materials or are specifically requested from us confirming being the latest versions. We offer no guarantee that the data sheets, inserts, instructions for use on the website are the most current versions and that there would be no deviation on the ones which accompany the shipment.

Warranty

KRISHGEN’s products are warranted to meet our product specifications in effect at the time of shipment. Notice of nonconforming products must be made to KRISHGEN within 3 days of receipt of the product. This product warranty limits KRISHGEN’s liability to the replacement of the supplied product only and in no way covers any other liabilities. In no events, shall KRISHGEN be liable for any kinds of losses or damages resulting from the use of KRISHGEN’s products.

For Products distributed by KRISHGEN, KRISHGEN accepts liabilities only to the extent of the acceptance of the same by the principal manufacturer and limits itself only to replacement of the product supplied, subject to acceptance of the claim by the principal manufacturer.

While we use reasonable efforts to include accurate and up-to-date support for selling, distributing, handling, usage & storage of our products, we make no warranties or guarantees for their efficacy. We are not responsible for any errors or omissions or the results obtained due to the intrinsic nature of such products which require optimal handling, usage skills & correct storage solutions. We will be liable only till the extent of the liability accepted by the manufacturer / supplier of and not beyond that. Our liability in such cases will be valid till 3 days from receipt of materials. Beyond the indicated date, no product complaints or liabilities will be accepted.

Limited Warranties for consumables. Unless a different written warranty is included with product literature, we warrant that each consumable will meet its specifications stated in our published catalogs, data sheets and instructions for use / inserts. This warranty lasts from the time we deliver the consumable until either the consumable’s expiry or “use by” date or its specified number of uses.

OUR WARRANTIES EXTEND ONLY TO YOU, THE ORIGINAL PURCHASER, AND YOU CANNOT TRANSFER THEM. IN NO EVENT WILL OUR TOTAL LIABILITY FOR BREACH OF WARRANTY EXCEED THE PURCHASE PRICE OF THE PRODUCT OR SERVICE. THE ABOVE WARRANTIES ARE EXCLUSIVE, AND WE MAKE NO OTHER REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OF NON-INFRINGEMENT, OR REGARDING RESULTS OBTAINED THROUGH THE USE OF ANY PRODUCT OR SERVICE, WHETHER ARISING FROM A STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF PERFORMANCE, DEALING OR USAGE OF TRADE, ALL OF WHICH ARE EXPRESSLY DISCLAIMED.

Note: If the above terms are not acceptable to you, promptly intimate/return any products in the package in which they were received with the storage conditions maintained. Failure to promptly return the product and/or any use of the product constitutes acceptance of the above terms.

Limitations of Liability:

We will not be liable under any legal theory (including but not limited to contract, negligence, strict liability in tort or warranty of any kind) for any indirect, incidental, special, punitive, multiple, exemplary or consequential damages (including but not limited to costs of cover, loss of profits, loss of data. loss of business, loss of goodwill or loss of revenue) that you might incur under the contract, or that may arise from or in connection with our products or services, even if we had notice of the possibility of such damages. In addition, our maximum aggregate liability out of or in connection with the contract, or any product or service, is limited to the amount you paid us for the product or service purchased. However, these provisions do not limit our liability for death or personal injury caused by our negligence or fraud, fraudulent misrepresentation or any other liability that cannot be excluded by law.

DATES AND TIMES ARE ESTIMATES ONLY AND WE WILL NOT BE LIABLE (IN CONTRACT, DELICT, TORT OR OTHERWISE) FOR ANY LOSSES, EXPENSES, CLAIMS OR DAMAGES CAUSED BY A LATE DELIVERY

Governing Law: The Contract and performance under it will be governed by the laws of the city of Mumbai, India without regard to provision on the conflict of laws.
